These Terms and Conditions ("Guarantee Terms") outline the coverage guarantee ("Guarantee") provided by Signal Solutions Ltd ("Company," "We," "Us," "Our") for its Amplifi-Qx indoor mobile signal booster system ("System"). This Guarantee is effective upon the Customer's ("You," "Your") acceptance, demonstrated by proceeding with the installation and enrolling in the associated Amplifi-Qx ProCare Plan.
1.1. Upon successful installation and commissioning of the System by a Signal Solutions certified technician, the Company guarantees that the System will provide significantly improved and reliable indoor mobile signal coverage within the agreed-upon coverage areas of Your facility ("Coverage Areas").
1.2. This coverage will ensure robust voice calls and data services for the mobile network operators supported by the installed System ("Supported Networks").
To be eligible for and maintain this Guarantee, the following conditions must be continuously met:
2.1. Usable Donor Signal:
2.1.1. This Guarantee is expressly contingent upon the consistent availability of a sufficient and usable donor signal ("Usable Donor Signal") at the location of the System's donor antennas.
2.1.2. A "Usable Donor Signal" is defined as a consistent minimum signal strength, typically -95 dBm or better, for each Supported Network's primary bands. This will be confirmed post-survey by a Signal Solutions certified technician during the pre-installation site survey and verified post-installation.
2.1.3. Should the Usable Donor Signal fall below this threshold due to external factors beyond the Company's reasonable control (e.g., mobile network operator changes, new third-party construction blocking signal, atmospheric conditions), the Company reserves the right to re-evaluate this Guarantee.
2.2. Amplifi-Qx ProCare Plan:
2.2.1. The Customer must enter into and maintain a continuous 5-year Amplifi-Qx ProCare Plan ("ProCare Plan") with Signal Solutions, commencing from the date of System commissioning.
2.2.2. The ProCare Plan ensures regular system health checks, firmware updates, proactive monitoring (if applicable to the chosen maintenance tier), and priority response to performance issues, aimed at preventing degradation and ensuring optimal System operation.
2.2.3. Lapse or termination of the ProCare Plan for any reason will immediately void this Guarantee.
2.3. Adherence to Design and Installation Specifications:
2.3.1. This Guarantee is valid only if the System is installed strictly in accordance with Signal Solutions' approved design specifications, the System manufacturer's guidelines, and all applicable local regulations and codes.
2.3.2. Any modifications, tampering, unapproved alterations, or relocation of System components by personnel not authorized in writing by Signal Solutions will void this Guarantee.
2.4. Environmental and Facility Stability:
2.4.1. This Guarantee assumes stable environmental and structural conditions within the facility as assessed at the time of the pre-installation site survey.
2.4.2. Significant structural changes to the facility (e.g., additions, demolitions, installation of new highly RF-absorbent or reflective materials), or the introduction of new large-scale RF-emitting or RF-blocking equipment not accounted for in the original System design, may impact System performance and may require a re-evaluation of this Guarantee or a System redesign at the Customer's expense.
2.5. Power Supply:
2.5.1. The Customer must ensure a continuous, stable, and appropriate power supply to all System components, as per the manufacturer's specifications and any requirements identified by Signal Solutions.
2.5.2. Failures or performance issues resulting from inadequate or unstable power supply are not covered by this Guarantee.
2.6. Amplifi-Qx Portal Access:
2.6.1. The Customer must maintain active access to and ensure the System remains connected to the Amplifi-Qx cloud portal ("Portal") for system monitoring and diagnostics, as provided or directed by Signal Solutions.
2.6.2. This Portal access facilitates proactive identification of potential issues and enables remote management and optimization of the System. Failure to maintain such access or connectivity may impede diagnostic capabilities and could impact the terms of this Guarantee or the timely provision of remedial actions.
3.1. In the unlikely event that the System fails to meet the Coverage Assurance as defined in Clause 1, provided all Guarantee Conditions and Requirements (Clause 2) are fully met by the Customer, Signal Solutions will, at its sole discretion and expense, undertake the necessary remedial actions.
3.2. Remedial actions may include, but are not limited to, System adjustments, re-configuration, or the addition of minor supplemental System equipment, until the guaranteed performance is achieved.
3.3. The Customer agrees to provide reasonable access to the premises and System components for such remedial work during normal business hours, or as otherwise agreed.
This Guarantee does not cover System performance issues or failures arising directly or indirectly from:
4.1. Failure, interruption, or degradation of the mobile network operator's external network or services.
4.2. Customer-supplied equipment, cabling, or infrastructure not installed or approved in writing by Signal Solutions as part of the System design.
4.3. Force majeure events, including but not limited to acts of God, natural disasters, fire, flood, war, terrorism, civil unrest, or governmental actions.
4.4. Misuse, neglect, accidental or intentional damage, vandalism, or improper operation of the System by the Customer or any third party.
4.5. Electrical surges, lightning strikes, or other power-related events not adequately protected against by Customer-provided infrastructure.
4.6. Interference from third-party equipment or radio frequency sources not present or declared during the pre-installation site survey.
5.1. This Guarantee commences on the date of successful System commissioning by a Signal Solutions certified technician.
5.2. This Guarantee remains in effect for the duration of the continuous 5-year Amplifi-Qx ProCare Plan entered into by the Customer. If the ProCare Plan is terminated or expires without renewal, this Guarantee shall automatically terminate on the same date.
By proceeding with the installation of the Amplifi-Qx System and enrolling in the Amplifi-Qx ProCare Plan, the Customer acknowledges that they have read, understood, and agree to be bound by these Guarantee Terms.
